There are a few factors that could affect your ability to recover. 1) Did you get a signed Agreement Between Brokers for this tenant? 2) Were you listed on the tenant application as the agent representative? If you have a signed ABB and were listed on the tenant application, it is irrelevant if the tenant self toured or was accompanied. However, in the absence of a signed ABB, you will have a hard time enforcing your claim to commission. When training my agents, I direct them to send the ABB with the initial tenant application. That way there is no question that compensation is expected for procuring the tenant.
Since the transaction is closed, the photos can only be removed by MLS Services. The agents no longer have access to make changes to a listing once it is marked as closed. There is a form they will send to the agent that you will need to sign, showing that it this is an owner request. Once that form is completed and returned, they can remove the photos from the old listing. Please note that this will only be for the pictures on HAR and will not ensure that the pictures are removed from other syndicated websites (Realtor.com, Homes.com, etc.).
It is my understanding that once a listing is set to Coming Soon, it can only be changed to active, withdrawn or terminated. You can confirm this with MLS Support.
