4 Legal Documents EVERY Family Should Have
I have seen so many Go Fund Me accounts or families at each others necks after a person's death or disability that it is scary how many are unprepared. Many seem to think they will always have time or such events wouldn't happen to them or their loved one. In the midst of this pandemic, mass shooting happening in places we thought were safe, car accidents, and other events it is important to have these things in order. One thing for sure in this life is death and taxes. Right?
There are 4 legal documents every family should have in the event of sickness, disability, or death.
- Wills. Adults have assets and a will can ensure those assets are properly distributed when a person is no longer with us. A will can also make sure your tax liability is kept at a minimum, so the heirs will reserve what they deserve.
- Durable Health Care Power Of Attorney. If you become incapacitated-such as in a coma or suffering a stroke- this document names the person authorized to talk with doctors and other health care providers to make decisions on your behalf.
- Durable Financial Power of Attorney. Id an adult family member is not capable of handling his or her financial affairs, this document names the person authorized to take over handling the finances. This is typically your sibling, partner or spouse, but always have an alternate in case the first person designated is also disabled.
- A Living Will, also known as an "advanced directive". This document is if you have an illness or in a condition diagnosed as terminal, but you are unable to communicate. The living will specifies whether you want medical professionals to try to keep you alive on artificial life support, or you want to decline those type of procedure. The document puts everyone on notice.
Additionally, if you have a child, you might want to talk to an estate planning attorney about the possible benefits of setting up a trust for her, him, or them.
