Are there any alternative to HAR400?

As we all know that HAR400 is obsolete? what are other realtors are used to inform about the water district to the buyer? TIA

Hiren! Great question! Since we no longer use the standardized MUD notice form, you will need to get this notice from the Municipal Utility District themselves as it is their job to provide. By law, each individual utility district is supposed to have this notice posted somewhere on their website, but sometimes it is not, or it is simply hard to find. In any event, if you are unable to locate it on their website, simply reach out to them by phone and/or email and ask them to send you the MUD notice / Special district notice. Example:I do a lot in FT Bend. Go to appraisal district and find the mud district. Then google that (MUD 48). Once you find the website search for the resource tab maybe located at the top of the page. Then go to documents, click that and look for "NOTICE TO PURCHASERS". Same rules apply - have signatures prior to contract being executed. Best of luck

I believe there are things you can assign to your seller. He has the contact numbers. He should be directed to alert his HOA and alert them he is selling and what does he need to do from their stand point. Involving the seller in things he can do to prepare to go on the market makes it a joint effort and the seller learns the process. Have the seller go to their MUD district site and pull the form and sign.

Morning Hiren. In short, Yes. According to Texas House Bill 2815 which became effective on June 18, 2023, the law covering notice required to a purchaser of property in a MUD changed. This change to the law made from HAR 400 obsolete and no longer useable under the new law and its notice provision. There is a separate law, Texas House Bill 2816, which contained similar language to HB2815 and has an effective date of September 1, 2023. Meaning all MUD info/forms shall be supplied by the applicable MUD. They can be found under https://districtdirectory.org Go to that web site, select the applicable county, then the district, where you will find all available info. If the MUD form isnt there you should call the applicable district and ask for it. Hope this helps

Hiren, you are supposed to go to the MUD district website where you can download the state-required form that not only details the rate and taxes/bonds to be paid back, but NOW it will indicates what the funds are being used for. Unfortunately, not all the districts are up to speed on the new law that took effect Sept 1st, 2023. You will need to speak to your broker on how to handle this part of the transaction if the MUD website does not have the information.
